Introduction
These Terms of Service (“Terms”) govern access to and use of the AutoScope websites, applications, APIs, Connected Vehicle Services, the RoadHawk LPR Network, and related services (collectively, the “Services”).
The Services are operated by AutoScope Labs Inc. (“AutoScope,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Additional Agency Documents
Use by or on behalf of an organization may also be governed by separate Agency Terms, order forms, data governance addenda, jurisdiction-specific attestations, sharing elections, or other written agreements and governance records (collectively, “Agency Documents”).
These Terms provide the general baseline for use of the Services and do not replace Agency Documents.
If these Terms conflict with an Agency Document, the Agency Document controls for the organization-specific subject it addresses unless that document states otherwise.
A governance election or attestation controls only the election, representation, or requirement it records and does not amend unrelated contract terms.
Eligibility and Authorized Use
The Services are intended for authorized users associated with approved law enforcement agencies, government entities, public safety organizations, private organizations, OEM and telematics providers, RoadHawk LPR Network participants, integrators, and other organizations accepted by AutoScope.
You may use the Services only within the authority granted by your organization and AutoScope.
You must use the Services lawfully and consistently with applicable agency policy, Agency Documents, permissions, and restrictions.
You may not use the Services to violate a person’s rights, exceed authorized access, interfere with security, introduce malicious code, scrape or reverse engineer the Services except where law prohibits that restriction, or make unauthorized disclosures of data.
Accounts and Credentials
You must provide accurate account information and keep it current. Accounts are individual and may not be shared.
You are responsible for protecting credentials and authentication methods and for promptly reporting suspected compromise, unauthorized access, or inaccurate permissions.
Your organization may administer, restrict, or request removal of your access.
Searches, Connected Vehicle Services, and Use of Results
You and your organization are responsible for having lawful authority and an authorized purpose for each search, alert, disclosure, export, or other use of the Services.
Where required, you must provide an accurate case or incident number and a meaningful justification.
AutoScope may provide Connected Vehicle Services through participating OEMs and telematics providers.
Vehicle location information is made available only with the required authorization and in accordance with applicable law and provider requirements.
Once permission has been granted by the vehicle owner, authorized law enforcement personnel may assist the owner with linking an eligible vehicle to the AutoScope platform, facilitating vehicle location sharing, and completing any required authorization steps in accordance with applicable laws and policies.
The RoadHawk LPR Network enables authorized users to perform federated license plate recognition searches across participating LPR providers through a unified interface.
Search results may include detections, images, timestamps, camera locations, confidence scores, mapping, timelines, and other available metadata.
You must independently assess all results before taking action. A detection, alert, match, image, GPS location, inference, or other output may be incomplete, delayed, or inaccurate and is not by itself a substitute for investigation or verification.
Agency Data
“Agency Data” means data, records, content, configurations, telematics information, LPR data, and other materials that an agency or its authorized users provide to, connect to, create in, or direct AutoScope to process through the Services.
As between AutoScope and the agency, the agency retains its rights in and control over Agency Data. Use of the Services does not transfer ownership of Agency Data to AutoScope.
The agency grants AutoScope a limited, non-exclusive right to host, process, transmit, display, reproduce, back up, secure, and otherwise use Agency Data only as reasonably necessary to:
- Provide, maintain, support, protect, and improve the Services.
- Follow authorized instructions and sharing elections.
- Comply with applicable law and agreements.
- Investigate misuse or security incidents.
Hosted and Federated Data
AutoScope may host certain data within its platform while also querying, displaying, transmitting, or facilitating access to data maintained by participating agencies, OEMs, telematics providers, RoadHawk LPR Network participants, or other third-party providers.
Hosted data is subject to AutoScope retention controls. Federated or source-system data remains subject to the policies, retention schedules, permissions, and legal requirements established by the originating agency or provider.
AutoScope cannot override provider restrictions, agency policies, or applicable legal requirements governing source-system data.
Permissions and Sharing
You may access, use, export, or share information only as permitted by law, your organization, applicable Agency Documents, and the configured permissions of the Services.
Participating agencies and RoadHawk LPR Network providers retain control over sharing permissions, retention policies, and access controls applicable to their data.
Unauthorized redistribution, credential sharing, or attempts to bypass access restrictions are prohibited.
Third-Party Services and Integrations
The Services may integrate with OEM telematics providers, Connected Vehicle Services, RoadHawk LPR Network participants, license plate recognition providers, CAD systems, RMS platforms, authentication providers, mapping providers, APIs, and other third-party services.
AutoScope does not control third-party systems and is not responsible for their availability, accuracy, security, retention, or continued operation.
Service Availability and Changes
We work to maintain reliable and secure Services but do not guarantee uninterrupted or error-free operation.
Maintenance, third-party outages, provider changes, network conditions, or source-system availability may affect results.
We may modify the Services to improve functionality, security, compliance, or reliability.
Suspension and Termination
We may suspend or terminate access when reasonably necessary to address suspected misuse, compromised credentials, legal or security risks, non-payment, loss of authorization, violations of these Terms or Agency Documents, or discontinuation of the Services.
Security and Cooperation
AutoScope employs commercially reasonable safeguards to protect the Services.
However, no system is completely secure.
Users and organizations remain responsible for maintaining appropriate account, device, network, and administrative security.
Disclaimers
To the fullest extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE.”
AutoScope does not warrant uninterrupted availability or guarantee the accuracy, completeness, timeliness, or suitability of telematics data, LPR detections, GPS locations, images, third-party information, or investigative results.
Users remain responsible for verifying information before taking operational or enforcement action.
Limitation of Liability
To the fullest extent permitted by law, AutoScope Labs Inc., its officers, directors, employees, contractors, affiliates, licensors, and service providers shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the Services.
Changes to These Terms
We may update these Terms to reflect changes in the Services, legal requirements, security practices, or business operations.
Continued use of the Services constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Delaware, unless otherwise specified in an applicable Agency Document.
General
If any provision of these Terms is determined to be unenforceable, the remaining provisions remain in full force and effect.
Sections relating to data rights, intellectual property, disclaimers, liability, audit logging, and governing law survive termination.
