Agreement
These Terms govern access to and use of the AutoScope applications, the RoadHawk LPR network, and autoscope.io (the "Services"), provided by AutoScope Labs Inc. ("AutoScope").
By accessing the Services, you agree to these Terms on your own behalf and on behalf of the agency or organization you represent ("Agency"). If you do not have authority to bind your Agency, do not access the Services.
Where AutoScope and an Agency have signed a separate written agreement, that agreement controls over any conflicting provision here.
Definitions
Authorized User: an individual employed by or contracted to an Agency, approved by AutoScope and by that Agency, holding valid credentials.
Agency Data: data an Agency owns or controls, including LPR reads from systems it operates or licenses, case identifiers, and records its users create.
Connected Vehicle Data: location and vehicle information retrieved from a connected vehicle service under authorization from the vehicle's owner.
Shared Data: Agency Data made searchable to another Agency under a sharing arrangement.
Eligibility and accounts
Access is limited to Authorized Users at agencies AutoScope has onboarded. Accounts are personal and may not be shared, transferred, or used by anyone other than the individual to whom they are issued.
You must use an agency-issued email address, maintain accurate account information, enable multi-factor authentication where offered, and notify AutoScope promptly of any suspected compromise.
An Agency's administrator is responsible for requesting removal of users who leave or change assignment.
Permitted use
The Services may be used only for a legitimate official purpose connected to an active investigation, case, or public safety function within the Authorized User's lawful authority.
Where the Services prompt for a case number or purpose, that entry must be accurate.
Prohibited use
You may not:
- Use the Services for personal reasons, including queries about family, acquaintances, coworkers, romantic interests, or yourself.
- Query a vehicle without a legitimate official purpose.
- Use the Services for harassment, intimidation, or to further any unlawful act.
- Use the Services to identify or monitor individuals on the basis of political activity, religious practice, or participation in lawful assembly or protected speech.
- Share credentials, or allow access by anyone who is not an Authorized User.
- Export, resell, or redistribute data obtained through the Services except as permitted by your Agency's policy and applicable law.
- Attempt to circumvent access controls, retention limits, sharing restrictions, or audit logging.
- Scrape, bulk-extract, or reverse engineer the Services.
Violation may result in immediate suspension and notification of your Agency.
Connected Vehicle Data and owner authorization
Connected Vehicle Data is available only where the vehicle owner has authorized access for a specific incident.
Authorized Users agree to:
- Obtain the owner's authorization directly from the owner, or verify that it has been obtained.
- Present the applicable terms to the owner before authorization is given.
- Never collect, record, or retain an owner's connected service credentials.
- Deactivate the vehicle in AutoScope when the incident is resolved or authorization is withdrawn.
AutoScope is not the custodian of the owner relationship and does not warrant that any given vehicle has an active connected service or that the owner will authorize access.
Agency Data ownership
Agency Data belongs to the Agency. AutoScope claims no ownership and processes it on the Agency's instructions.
AutoScope will not:
- Sell Agency Data.
- Use Agency Data to train machine learning models.
- Disclose Agency Data other than as described in the Privacy Policy or as the Agency directs.
Sharing between agencies
An Agency controls whether its data is searchable by another Agency. Sharing occurs only where an arrangement authorizing it is in place, and may be scoped and withdrawn by the sharing Agency.
Data received from another Agency remains that Agency's data. A receiving Agency must handle it consistently with the sharing arrangement, its own policy, and applicable law, including any retention and dissemination limits imposed by the originating Agency.
Audit and cooperation
All activity is logged. Logs are available to the employing Agency, to an Agency whose data was queried, and to AutoScope for security purposes.
Agencies agree to investigate misuse identified through audit and to cooperate with AutoScope's reasonable requests in connection with a suspected violation.
AutoScope may suspend a user or an Agency where it reasonably believes the Services are being misused, and will notify the Agency's administrator.
Accuracy and investigative judgment
The Services return data produced by third-party systems, including LPR vendors and connected vehicle services. AutoScope does not warrant the accuracy, completeness, or timeliness of that data.
Plate recognition is probabilistic and produces errors. Location data may be delayed, imprecise, or unavailable.
Results are investigative leads, not conclusions. Authorized Users are responsible for independently corroborating any result before acting on it, and for any operational or enforcement decision made in reliance on the Services.
Evidentiary use
Where a record obtained through the Services is used in a proceeding, the Agency is responsible for authentication and for compliance with applicable evidentiary rules and disclosure obligations.
AutoScope will reasonably assist with source, provenance, and audit information upon lawful request.
Third-party services
The Services interoperate with third-party vendor systems and connected vehicle services. Use of those systems is subject to their own terms.
AutoScope is not responsible for third-party availability, changes, or discontinuation.
Fees
Where applicable, fees, payment terms, and subscription scope are set out in a separate order or agreement.
Access provided without charge may be modified or withdrawn on notice.
Intellectual property
AutoScope retains all rights in the Services, including software, interfaces, and documentation.
These Terms grant a limited, revocable, non-exclusive, non-transferable right to use the Services during the term.
AutoScope names and marks may not be used without written permission.
Warranty disclaimer
The Services are provided "as is" and "as available." To the maximum extent permitted by law, AutoScope disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Services will be uninterrupted or error free.
Limitation of liability
To the maximum extent permitted by law, AutoScope is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or operational losses, arising from use of or inability to use the Services.
AutoScope's aggregate liability will not exceed the greater of the amounts paid to AutoScope in the twelve months preceding the claim, or [AMOUNT].
Nothing in this section limits liability that cannot be limited by law.
Indemnity
To the extent permitted by applicable law, and subject to any limitation applicable to a governmental entity, each party will be responsible for claims arising from its own acts or omissions in connection with the Services.
Term, suspension, and termination
These Terms apply while you have access. Either party may terminate on notice.
AutoScope may suspend or terminate access immediately for a violation of Section 5, a security risk, or a legal requirement.
On termination, access ends. Agency Data will be handled as described in the Privacy Policy and any applicable agreement, and returned or deleted on the Agency's instruction subject to legal retention requirements.
Governing law and disputes
These Terms are governed by the laws of [STATE], without regard to conflict of laws principles.
The parties will attempt in good faith to resolve any dispute before initiating proceedings.
Venue lies in [VENUE], except where an Agency is prohibited by law from agreeing to that venue, in which case the parties' respective jurisdictional rules apply.
Changes
AutoScope may update these Terms. Material changes will be communicated to Agency administrators before taking effect.
Continued use after the effective date constitutes acceptance.
